The Mexican Social Security Institute (IMSS) will verify that the acknowledgment of workers who were subcontracted has not negatively affected their salary level, or the risk premium registered before this institution.

Norma Gabriela López Castañeda, director of Incorporation and Collection of the IMSS stated that 2.9 million workers who were subcontracted have been migrated to the main payrolls of the companies, as a result of the reform on subcontracting.

“What we reviewed is that this migration did not entail a negative effect on the salary or in the premium for occupational hazard insurance; we reviewed that migration was conducted in accordance with the principles of the reform. And, should that not be the case, (employers) are invited to review this situation and, in the event that there are differences, that they cover said differences”, she pointed out during her participation in the seminar on “The transformation of employment relationships.”

As a result of the reform that prohibited outsourcing, a salary increase of 20 percent was reported for workers who were in that situation.

López Castañeda warned that a greater migration of workers who were subcontracted is not expected, given that the bulk of this migration took place last year.

“As an effect of the reform on subcontracting (a greater migration is not expected), because the implementation of the reform took place practically from the month of April to September and the numbers that were projected were reached”, she said.

On another topic, she promoted an application implemented by the IMSS that enables workers to be aware of contributions before the institute, with the objective of avoiding bad practices, such as employers registering a worker for a month and then de-registering him.

“Every month, you will receive information on which employer has registered you, with which salary and how many days of social security dues you accumulated. You do not have to wait until you reach your pension age to know the status of the contributions made for you”, she explained.
