After two days of voting, employees of the General Motors plant in Silao, Guanajuato, tore the collective bargaining agreement from the hands of the CTM union “Miguel López Trujillo” under the rapid consultation mechanism provided for in the USMCA.

Out of 5 thousand 876 workers that issued their vote, 3 thousand 214 opted to terminate the contract with the CTM guild. Now, the Department of Labor, which ensured that the workers will keep their labor benefits and conditions, must review the information of the process that was supervised by the INE [National Electoral Institute] and ILO.

In April, the US filed a complaint within the framework of the USMCA after the workers of GM-Silao denounced anomalies in the consultation to validate or reject the collective bargaining agreement in force, which made it necessary to conduct the process once again.

While the CTM warned that it will contest the voting, in the opinion of specialists, the result of the consultation could bring labor uncertainty but also shows that Mexico fulfills its commitments to the Treaty.

“The participation of the US unions (in the process) does not have the objective of improving working conditions but, rather, to generate labor uncertainty”, warned Óscar de la Vega, a lawyer specializing in labor matters.

In the opinion of Mario Echegaray, partner in charge of the foreign trade practice at Salles Sainz Grant Thormton, the process will provide certainty for investments.
